HoR to decide on bills on conflict of interest, election law, public procurement

SARAJEVO, October 13 (FENA) - At the session scheduled for tomorrow, the House of Representatives of the BiH Parliamentary Assembly should consider the Bill on Prevention of Conflict of Interest in the Institutions of Bosnia and Herzegovina, proposed by MPs Saša Magazinović (SDPBiH), Damir Arnaut (Our Party) and Jasmin Emrić (A-SDA).

The Constitutional-Legal Committee of the House of Representatives, in the second phase, supported the proposal of this law with 22 adopted amendments.

It is also planned to consider the Bill on Amendments to the Law on Court Fees in the procedures before the Court of BiH, proposed by the Council of Ministers of BiH, which creates conditions for establishing an efficient mechanism for collecting court fees.

The Bill on Public Procurement of Bosnia and Herzegovina, whose proponents are deputies from the Democratic Front Club, should also be considered, with the opinion of the Constitutional Committee.

The Constitutional Committee assessed that the Bill is not harmonized with the Constitution and the legal system of BiH, and submitted a negative opinion to the House.

The agenda should also include the Bill on Amendments to the Election Law of BiH, proposed by MP Saša Magazinović, which envisages the abolition of the possibility for elected officials to hold several positions simultaneously.

Magazinović stated that he forwarded the Bill into the procedure due to the fact that we have a number of examples of officials holding double positions, e.g., persons who are both MPs and ministers which is unacceptable for several reasons.

He emphasized that it is physically impossible to do the job of a minister and the job of an MP at the same time and that the accumulation of power in one person is not a democratic principle that we should strive for.

On the other hand, he stated that no one disputes that these persons have the support of the citizens and that they won a mandate in the parliaments. Therefore, this proposal to amend the Election Law envisages the possibility of putting the mandate on hold. In that case, the function of the representative shall be performed by the next candidate on the list, as long as the term of office of the Minister lasts in the executive branch.
