ECHR renders judgment that BiH has discriminated against Svetozar Pudarić

FENA Press release

STRASBOURG/SARAJEVO, December 8 (FENA) - The European Court of Human Rights in Strasbourg today, in the case of Pudarić v. BiH, ruled that Bosnia and Herzegovina has discriminated against Svetozar Pudarić in connection with the right to run for the Presidency of BiH from the ranks of the Serb people from the territory of the Federation of BiH.

"The Pudarić v. BiH judgment indicates that the provision of Article V of the BiH Constitution does not meet the standards of prohibited discrimination from Article 1 of Additional Protocol No. 1 to the European Convention because it does not guarantee political equality of its citizens," said his lawyer Nedim Ademović.

After the judgments in the cases of Sejdić and Finci, Zornić, Šlaku, this is another judgment of the European Court of Human Rights which confirmed that the BiH Constitution is discriminatory against many BiH citizens because it denies them the right to political participation in public office, only and exclusively because of their ethnic (non)affiliation, the statement said.
