BiH PA HoP rejects amendments to the Laws on public procurement and medicines

SARAJEVO, March 2 (FENA) - Deputies of the House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina (BIH PA HoP) rejected proposals for a law amending the Law on Public Procurement and the Law on Medicines and Medical Devices, which was supposed to facilitate the procurement of coronavirus vaccines.

The deputies agreed to consider the amendments to the two legal solutions under the urgent legislative procedure, which was the request of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina, which had previously supported the amendments.

Thus, the amendments to those two laws will be sent to the Collegium of the House for subsequent harmonization, since there was not enough entity support from Republika Srpska for their adoption, because four deputies of the Serb caucus were against while one abstained.

An attempt to harmonize the members of the Collegium immediately at the session was not possible, because the Deputy Speaker of the House of Peoples Dragan Čović (HDZ) did not attend the session from the Croat people.

As stated in the explanation, the goal of the amendment to the Law on Public Procurement is to enable the procurement of vaccines for immunization of the population of Bosnia and Herzegovina from Covid-19 in the fastest way and to ensure the protection of their lives and health.

On the other hand, the aim of the amendment to the Law on Medicines and Medical Devices is to enable access to vaccines and other medicines for the prevention and treatment of infectious diseases and to protect the life and health of the population of BiH.

This legislative proposal has improved the existing legal solution following the basic principle related to enabling the competent authorities to act in situations when the manufacturer of medicines for infectious diseases requires special conditions.

The deputy from the Serb caucus, Dušanka Majkić (SNSD), believes that the proposed amendment to the Law on Public Procurement is completely unnecessary because the existing law on public procurement enables what needs to be done.

The Speaker of the House of Peoples, Bakir Izetbegović (SDA), invited the deputies to look at Article 10 of the Law on Public Procurement, which deals with exemptions from the application of the provisions of this law.

“If we do not adopt this today, the procurement of vaccines will be subject to the deadlines prescribed by law, and then we can be guilty of not removing this obstacle to faster procurement of vaccines. Apart from the evident slowness, the indolence of the authorities, we can be guilty because we stopped something that happened in the House of Representatives, and which enables the acceleration and simplification of procedures,” stated Izetbegović.

He appealed to the deputies not to be the ones who created another obstacle, another problem for the people who do not have what they need to protect themselves at the time of pandemic.

The deputy from the Bosniak caucus, Denis Bećirović (SDP), assessed that these laws will not systematically solve the problems that BiH is facing, but they are still a step forward.

He also suggested that the Chairman of the Council of Ministers of BiH, Zoran Tegletija, be invited to the session and express his opinion in this situation, but also to inform the House and the public about some elementary things.
