OHR: Dismissals of BPC Assembly leadership illegal

GORAŽDE, March 4 (FENA) - The Office of the High Representative in BiH (OHR) sent a letter to the Assembly of the Bosnian Podrinje Canton (BPC) stating, among other things, that the decisions made at the 10th extraordinary session, at which the Deputy Speaker of the Assembly Edita Velić and Minister of the Interior (MoI) Nizama Rišljanin were dismissed, are not legal and that the Speaker of the BPC Assembly is still Daliborka Milović.

The letter states that the dismissal followed even though a vital national interest was launched in the decision on the dismissal, which was ignored by the parliamentary majority.

“Based on the information submitted to the OHR, although the Cantonal Assembly at its 9th extraordinary session held on 5 February considered the proposed decision to dismiss the Deputy Speaker of the Assembly Edita Velić, both the Speaker of the Assembly Daliborka Milović and Deputy Speaker of the Assembly Velić launched a procedure of protection of vital national interest. Also, the Serb Caucus in the Assembly, by consensus, launched a procedure of protection of vital national interests in connection with the proposed decision as well,” Inzko states in the letter, assessing that the constitutional and legal frameworks were not respected.

In this regard, he emphasizes that if more than one speaker or deputy speaker of a cantonal legislature launches a procedure of protection of vital national interest, the adoption of such an act requires a majority vote within each of the constituent peoples' caucuses represented in the cantonal assembly.

"This procedure was not carried out. Although the Bosniak Caucus voted for the adoption of the proposed act, the Croat and Serb Caucuses did not do so and therefore it is necessary to vote in the Croat and Serb Caucuses on the proposed decision. Initiating the protection of vital national interest by more than one speaker or vice-speaker is not subject to consideration of that issue before the Council for the Protection of Vital National Interest at the Constitutional Court,” Inzko's letter stated.

The High Representative in BiH assesses that during the scheduling of the 10th extraordinary session of the cantonal parliament at which the disputed decisions on dismissals and appointments were made, after the interruption of the 9th extraordinary session, the Rules of Procedure of the BPC Assembly were ignored and that the Deputy Speaker Edim Fejzić, who scheduled the session, could not convene it because the provisions of the Rules of Procedure were not met.

"Consequently, this event did not meet the necessary legal requirements to be considered as a session of the Assembly, and the acts adopted on that occasion cannot be considered valid, including the attempt to dismiss Deputy Speaker Velić and the confirmation of a new member of the Canton leadership, as well as decisions to dismiss and appoint a new BPC interior minister. Moreover, the members present at the "extraordinary session" of the Assembly neglected the procedure of vital national interest, which was initiated on the same day in connection with the proposed act on the removal of Deputy Speaker Velić," Inzko explained.

Dismissed speaker of the BPC Assembly, Daliborka Milović (LS), pointed out that such an attitude of the OHR is expected.

Dismissed deputy speaker of the BPC Assembly, Edita Velić (DF), is not optimistic regarding the respect for the position of the OHR's by the parliamentary majority.

The parliamentary majority in the BPC Goražde Assembly believes that the OHR gave their interpretation and did not make any decision, as the opposition wants to present. They added that the opinion itself is based on wrong information provided to the OHR.
