SARAJEVO, June 23 (FENA) - Changing "election legislation" is not possible without changes to the Constitution of Bosnia and Herzegovina, the Council of Congress of Bosniak Intellectuals (VKBI) said, recalling that the activities of domestic and international representatives and ambassadors regarding changes in the election legislation in Bosnia and Herzegovina have intensified in recent weeks.
“We call on all domestic and international actors in Bosnia and Herzegovina to clearly define the need to amend the Constitution of BiH (at least in terms of implementing the judgments of the European Court of Human Rights), and not to use the phrase "changes in electoral legislation", which creates confusion in the public that the judgments of the European Court can be implemented by amending the BiH Election Law. The implementation of the judgments of the European Court requires changes to the BiH Constitution, and only then the harmonization of the BiH Election Law with the amended provisions of the Constitution of Bosnia and Herzegovina. Placing the thesis that the judgments of the European Court can be implemented by amending the BiH Election Law is a fraud and untruth. It is important to remind domestic and international public that in the context of implementation of the judgments of the European Court of Human Rights in Strasbourg, which is an international obligation of Bosnia and Herzegovina, (judgment in favor of Sejdić-Finci v. BiH, 2009 2014, judgments in favor of Ilijaz Pilav and Samir Šlaka from 2016 and in favor of Svetozar Pudarić against BiH from 2020) it is not possible to change the “electoral legislation” of Bosnia and Herzegovina without amending the Constitution of BiH, primarily Article V of the Constitution of BiH,” said VKBI in a statement.
The European Court of Human Rights has ruled that the Constitution of BiH discriminates against practically all citizens of Bosnia and Herzegovina from all nations and others, which otherwise guarantee all the rights from the United Nations Universal Declaration of Human Rights and from the European Convention for the Protection of Human Rights and Fundamental Freedoms.
