OSCE Mission and EU Delegation support more effective administration of justice

SARAJEVO, July 2 (FENA) - The OSCE Mission to Bosnia and Herzegovina has noted that the judiciary's response to corruption is inadequate, especially when it comes to prosecuting high- and middle-ranking perpetrators of corruption.  

The OSCE Mission to Bosnia and Herzegovina and the Delegation of the European Union to BiH presented today a new regional project "Supporting a More Effective Administration of Justice in Corruption and Organized Crime Cases in the Western Balkans through Trial Monitoring".  

Deputy Head of the OSCE Mission to BiH Dmitry Iordanidi assessed that there are problems that undermine the productivity and efficiency of the judicial system, and prosecuting acts of corruption is a key aspect for strengthening the rule of law.

The implementation of projects in BiH, Iordanidi explained, will serve as a mechanism for monitoring the implementation of previously given OSCE and EU recommendations related to the processing of organized crime and corruption cases.

He expressed hope that this project would help strengthen the work of the judiciary in cases of this kind, because the rule of law means that office holders can be held accountable for their actions in a fair trial and that criminal networks can be broken and their profits confiscated.

He also stressed that the rule of law means that perpetrators of high-level corruption and organized crime will no longer go unpunished, and expressed readiness for the OSCE Mission to support the judiciary in dealing with the most serious forms of these crimes.

Head of the European Union Delegation to BiH and the EU Special Representative in BiH, Johann Sattler, emphasized today that the rule of law is alpha and omega of the process of joining the European Union, expressing disappointment that very little has been done in the past.

He noted that one of the most important issues is for judicial institutions to show concrete results in setting a measurable effect in terms of filing more indictments and passing more verdicts because this does not happen especially in high corruption cases. 

Sattler says that when it comes to the Conflict of Interest Act, the opinion of the Venice Commission, which is a body of the Council of Europe, is expected, and it should be referred to the parliamentary procedure. It is important to pass this law in order to eliminate incompatibility of functions from the system.

“This means that at the same time it is not possible to perform a function in the executive and legislative power or in the executive power and public companies. We expect progress in this regard next month,” Sattler explained.

He also referred to the issue of non-prosecution of election thefts, emphasizing that there is another project that is being worked on with civil society in terms of improving the election process in BiH because citizens are losing trust, and it is necessary to introduce innovations.

As announced, the OSCE Mission and the EU Delegation will jointly monitor the processing of corruption and organized crime cases and the implementation of expert recommendations arising from the project launched today.
