CEC BiH adopts Initiative for Adoption of Amendments to Election Law

SARAJEVO, September 16 (FENA) - At last night's session, the Central Election Commission of Bosnia and Herzegovina adopted a Conclusion on the adoption of the Initiative for the adoption of the Law on Amendments to the Election Law of Bosnia and Herzegovina.

The adopted Initiative is the result of several months of work of the Central Election Commission of BiH.

The CEC reminds that in June they adopted the draft Initiative for the adoption of the Law on Amendments to the BiH Election Law, which they sent to the Venice Commission and GRECO through the Council of Europe and the OSCE/ODIHR, with a request for an opinion.

The CEC states that on August 16, 2021, the OSCE Office for Democratic Institutions and Human Rights (OSCE / ODIHR) submitted to the BiH Central Election Commission “Informal Comments on the Draft Amendments to the Election Law from the Draft Initiative” which include proposed amendments to the BiH Election Law drafted by the BiH Central Election Commission.

They add that, in the opinion of the OSCE Office for Democratic Institutions and Human Rights (OSCE / ODIHR), the proposed amendments to the Election Law prepared by the BiH Central Election Commission are “broad and show significant progress in reviewing some recommendations formulated by previous elections. The proposed changes address, inter alia, issues related to the delimitation of constituencies, the way polling stations are formed, the misuse of public resources for campaign purposes, the training of election officials, women's participation in elections and the timely publication of CEC and court decisions on complaints. for elections. If adopted, the changes will strengthen the integrity of the election process. Numerous other amendments address technical issues, clarifying previous ambiguities and aligning certain provisions with the BiH Constitution and other laws. Other proposals relate to the postponement of elections in case of extraordinary circumstances, voter registration, nomination of candidates, media regulations, agreements on early (early) voting and election violations”.

The Council of Europe submitted a response to the Central Election Commission of BiH that the Venice Commission and GRECO cannot give their opinion at this stage of drafting the law.

In accordance with the competencies from the BiH Election Law, the BiH Central Election Commission will send the Initiative to the BiH Parliamentary Assembly, and inform the members of the BiH Presidency, the BiH Council of Ministers, the OHR, the Peace Implementation Council, the EU Delegation / Special Envoy's Office. The EU in BiH and the OSCE Mission to BiH, and after it is delivered to the above addresses, will be published on the website of the Central Election Commission of BiH, according to the institution.
