Tadić: There was no direct pressure on me

MOSTAR, September 24 (FENA) - Tudor Pantiru, the vice president of the Constitutional Court and international judge, who is ending his engagement at Bosnia and Herzegovina's Constitutional Court, said in Mostar today that the constitutional court makes decisions independently, although there is a lot of pressure.

“The Constitutional Court is one of the most important institutions of BiH, which has the task of supporting and defending the Constitution of BiH. In my opinion, it is an independent institution that makes decisions independently, although there is a lot of pressure coming from outside. This is one of the most complex activities that this court is facing precisely because of the complex organization of the state itself,” said Pantiru.

He added that this court is facing probably the most complex task if we look at other constitutional courts even in the whole world, precisely because of the structure of Bosnia and Herzegovina itself.

“We live with it and work with it,” said President of the Constitutional Court of Bosnia and Herzegovina Mato Tadić, answering the question of journalists about possible political, i.e. pressure from outside.

“There is no direct pressure on me, and on my colleagues, or if there are, they are not of such a nature to influence our work and our decision-making,” he added.

He reiterated that the Constitutional Court has its jurisdiction, which is established by the Constitution, which, as he says, they adhere to and work on.

“Our decisions are final and binding according to the Constitution and what we insist on, we insist on the execution of our decisions, regardless of who comments,” Tadić stressed.

When it comes to abstract jurisdiction, that is, the assessment of constitutionality, Tadić said that they have seven, conditionally, eight unexecuted decisions. Most of these decisions were not implemented by the BiH Parliamentary Assembly, and three were not implemented by the FBiH.

In relation to the Republika Srpsksa entity, we have an interesting situation, Tadić emphasized, where "negative comments are coming, but they are executing decisions".

“Truth be told, when I say they executed the decisions, they did not execute the decision related to the Republic Day, where we determined the violation. They did not pass a new law, but that old law was put out of force,” said Tadić.
