Our party proposes a set of changes to the BiH Constitution

SARAJEVO, September 27 (FENA) - Today, Our Party submitted to the protocol of the Parliamentary Assembly of Bosnia and Herzegovina the Proposal for Amendments to the Constitution of BiH and presented it today at a press conference in Sarajevo explaining that it would present minimal changes that satisfy the judgments of the European Court for Human Rights, but also take full account of all the realities of BiH.

Our Party MP in the House of Representatives of the Parliamentary Assembly of BiH, Damir Arnaut, said that their proposals for amendments to the Constitution of BiH take into account those judgments and the political reality of BiH.

He explained that instead of the three-member Presidency of BiH, one President of BiH is being introduced, who has a Vice President. The president is not elected in elections, but in the Parliamentary Assembly. Every citizen of BiH, regardless of ethnicity, can be the president of BiH", stated Arnaut.

However, he added, given that it is an individual, that official does not have any essential powers, he will only have ceremonial powers.

According to the proposal of Our Party, all the essential powers that the current Presidency has - foreign policy, defense, the appointment of ambassadors, etc., are transferred to the Council of Ministers of BiH. Arnaut says that the Council of Ministers is elected as it has been elected so far, it decides as it has decided so far.

According to him, the president is limited to one term and the president and vice president cannot be from the same constituent people or both from the ranks of Other nations.

When it comes to the House of Peoples, Arnaut says that the rulings of the European Court of Human Rights due to discrimination in its membership also apply to that House.

"The House of Peoples is abolished and the model we have in the entity parliaments is applied, so that the presence of at least six Serbs, Croats, Bosniaks and others is guaranteed in this house in the Parliamentary Assembly, four from the Federation of BiH, two from the RS, respecting the entity ratio that applies to everyone in BiH," said Arnaut.

He said that following the example of the cantonal assemblies, members of the people and others form their own ad hoc clubs for the purpose of protecting vital interests and other necessary issues.

The proposed solutions envisage that the majority in each club can seek the protection of the vital interest of the people to whom it belongs, i.e. the others. If the majority in another club opposes, the case goes to the Constitutional Court for a final decision, identical to the existing system.

"The existing system does not change at all. Vital interest is protected as before. No nation, no entity is losing the powers and mechanisms it currently has, the entity voting remains complete," Arnaut explained.

The Parliamentary Assembly would have a chairman and a deputy. These four persons, the Speaker and Deputy Speaker of the Parliamentary Assembly, the President and the Vice-President, will be from three different nations and among others.

"These are ceremonial functions and they will be distributed between this magic number four. Everything in the Council of Ministers remains as it is, only it gets additional powers. When it comes to the election of the Council of Ministers and its decision-making, everything remains as it is," Arnaut explained.

He added that the adoption of these amendments would put BiH on the map of normal European states that cultivate parliamentary democracy.

The President of the Main Board of Our Party, Sabina Ćudić, assessed that the proposal of Our Party is revolutionary because it does what was considered impossible until now. It reconciles the models that ensure the erasure of the ethnic prefix for candidates for the position of President of BiH, and at the same time strengthen the state by increasing the number of deputies in the state parliament and strengthen the body that should make key decisions for BiH, the BiH Council of Ministers and the prime minister's position.
