Bratić: There is no return of competencies without consent of state institutions

BANJA LUKA, October 20 (FENA) - The representative of the group 'Together for Bosnia and Herzegovina' in the National Assembly of Republika Srpska Senad Bratić said that the Bill considered by the entity-body of Bosnia and Herzegovina today is unconstitutional and an obvious example of the violation of the Constitution and the Dayton Peace Agreement.

A special session of the National Assembly of the Republika Srpska is underway in Banja Luka to discuss the Information on the Situation of Oxygen Delivery to Public Health Institutions in RS and the Draft Law on Medicines and Medical Devices of RS, which envisages the establishment of an entity drug agency.

Bratić reminded that then prime ministers Mustafa Mujezinovic (FBiH) and Milorad Dodik (RS) and BiH Council of Ministers Chairman Nikola Špirić signed an agreement in 2009 to establish the BiH Medicines and Medical Devices Agency.

He noted that such a law could provoke international sanctions because it violates the Dayton Peace Agreement, adding that the return of competencies to the entities requires an agreement between the two BiH entities, as well as a positive opinion of the BiH Parliamentary Assembly on that agreement.

It is also possible that the Presidency of BiH will launch an initiative towards the Council of Ministers of BiH and the Parliamentary Assembly of BiH to return certain competencies to the entities, Bratić notes, or to pass an amendment in a certain law at the state level through a parliamentary initiative.

“This means that RS without the consent of state institutions cannot constitutionally return the transferred competencies. Such a return of jurisdiction would be unconstitutional and RS would bear international sanctions,” Bratić underlined, presenting the interpretations of legal experts.
