BiH Public Procurement Agency files a report on suspicion of embezzlement

SARAJEVO, October 21 (FENA) - The BiH Public Procurement Agency has filed a report with the Republika Srpska Public Prosecutor's Office and the Basic Court in Banja Luka on suspicion of embezzlement in the public procurement procedure for equipment for the Rajska dolina Hotel owned by the RS Government Catering Service.

The agency reacted after Transparency International in BiH (TIBiH) sent a report in April this year due to suspicions of bid-rigging worth around 3.1 million KM.

“The Agency submitted a report to the Public Prosecutor's Office of the Republika Srpska - Special Department for the Suppression of Corruption, Organized and the Most Serious Forms of Economic Crime, on July 19, 2021, regarding the "potential violation of the Law on Public Procurement due to the existence of elements of a possible criminal offense." In the request for monitoring sent to the Agency, TIBiH stated that the Catering Service of the Government of the RS defined the procurement of goods as the procurement of services and thus increased the price of the basic contract by an additional 20 percent,” it is said in the statement.

In addition to the Public Prosecutor's Office of the Republika Srpska, the Basic Court in Banja Luka was informed about that case, i.e. the Department for Misdemeanors, to which the Public Procurement Agency, after the report of TI BiH on August 16, 2021, filed a request to initiate misdemeanor proceedings.

On April 9 this year, the Catering Service of the Government of the RS awarded an additional 435,075 KM without VAT to the supplier, the company 'Dineco', without a tender, for the purchase of the interior equipment service of the Rajska dolina Hotel through a negotiated procedure without public announcement.

"The Catering Service of the RS Government decided to change the subject matter of procurement, and with an additional contract awarded the bidder an additional half a million KM, which was not an adequate explanation, therefore the Agency filed the reports to the competent authorities,” said TIBiH.
