SARAJEVO, November 4 (FENA) - The House of Peoples of the FBiH Parliament today adopted the Law on the Representativeness of Trade Unions and Employers' Associations in the proposed text, and since the House of Representatives adopted the law with a certain amendment, it is necessary to harmonize the adopted texts, so that the said law may enter into force.
FBiH Minister of Labor and Social Policy Vesko Drljača said in a statement for FENA that this law regulates the criteria, conditions and procedure for determining the representativeness of trade unions and employers' associations on the territory of the Federation and in the cantons.
“Based on the established representativeness, the trade union or association of employers will have the right to represent its members before the employer and the authorities. Also, they will have the right to collective bargaining and concluding a collective agreement, as well as to participate in bipartite and tripartite bodies,” said Drljača.
When it comes to determining the representativeness of trade unions for the territory of the Federation of BiH, it is determined that a representative trade union for the mentioned level is considered to be a trade union that has, among other things, at least 20 percent of members in relation to the total number of employees in the Federation, in at least five areas of activity, according to the data of the body responsible for statistics, or another body that keeps appropriate records in BiH, and which operates in the area of at least three cantons.
