TIBiH: Problems of competence with the supply of medical oxygen

SARAJEVO, November 9 (FENA) - The Agency for Medicines of BiH and the RS Administration for Inspection Affairs have declared themselves incompetent for the supervision and control of oxygen traffic used in health care institutions in the Republika Srpska, which leaves this area in a legal vacuum, and endangers the safety of health care beneficiaries, announced the Transparency International Bosnia and Herzegovina (TI BiH).

According to the statement, after Transparency International Bosnia and Herzegovina asked the BiH Medicines Agency to initiate an inspection because some health care institutions procured oxygen from suppliers who do not have a certificate for the sale of medicines, the answer came that the entity inspections are responsible for this area, and that the Agency forwarded the evidence to the FBiH Administration for Inspection Affairs and the RS Administration for Inspection Affairs.

TIBiH states that inspections were carried out in health centers in Zenica, Živinice and Čelić and in the General Hospital in Sanski Most in connection with the procurement of medical gases for health care institutions.

“On that occasion, as the FBiH Health Inspectorate informed TI BiH, it was determined that health institutions in Sanski Most and Zenica procured oxygen from a wholesaler who does not have an authorization from the BiH Medicines Agency, and further use and procurement of oxygen from these suppliers was prohibited. The RS Administration for Inspection Affairs replied that they returned the case to the BiH Agency, claiming that this body is responsible for the supervision and potential withdrawal of the disputed product from the market. After this interpretation of the RS Inspectorate, the BiH Medicines Agency again declared itself incompetent by adopting an act reiterating the position that the inspection and control of product safety on the BiH market, as well as supervision over the work of health institutions in each entity are the sole responsibility of the relevant entity inspections,” it is added in the TIBiH statement.

Transparency International of Bosnia and Herzegovina states that in the letter from the Agency they remind that the health inspector of the RS Administration for Inspection Affairs in August this year performed an inspection in the Hospital Trebinje.

On that occasion, as it is stated, the information obtained by TI BiH was confirmed that this institution procured oxygen from the "Milojević Gilje - Gas Company", which does not have a license for the Agency's drugs, and that this oxygen was used for medical purposes. According to TIBiH, this case was the initiator of the affair, which was publicly called "Oxygen", and which opened the question of the correctness of oxygen used for treatment in health care institutions throughout BiH.
