BiH Constitutional Court confirms human rights violations with mandatory masks

MOSTAR, November 18 (FENA) - The Constitutional Court of Bosnia and Herzegovina has found several human rights violations when it comes to the mandatory wearing of a protective mask due to the coronavirus pandemic, but also a ban on the movement of persons over 65 years of age.

This was confirmed by the President of the Constitutional Court of BiH, Mato Tadić, at the conference on harmonization of court practice, which is being held today and tomorrow in Mostar, and at which the protection of rights during the Covid-19 pandemic was discussed.

Tadić said that everyone has the right to health and that the state must ensure the right to health for all citizens, but at the same time, it must find proportionality.

He also believes that this has been a very sensitive situation.

"We made several decisions in which we confirmed the violations, but in several instances, we also rejected the injuries. One of the decisions in which we determined the violation was made on November 16 at the session of the Supreme Council," Tadić added.

At the mentioned session of the Supreme Council of the Constitutional Court of BiH, the decision AP 1239/21 was singled out, in which the Constitutional Court concluded that interference with the right to "private life", which was done by the disputed conclusion of the RS government's emergency situations headquarters on the obligatory wearing of a protective mask indoors, is a violation of the right to "private life" when in the case of the adoption and review of the ordered measure there was no active participation of the highest legislative and executive authorities of the entity of Republika Srpska.

On the other hand, the Constitutional Court concluded that the part of the appeal requesting the revocation of the disputed conclusion due to the existence of an undoubted public interest in introducing the necessary measures to protect the population from the pandemic and the occurrence of negative consequences is unfounded.
