Party for BiH submits appeal against High Representative, Croatia and EU

SARAJEVO, September 1 (FENA) - The Party for Bosnia and Herzegovina (SBiH) on behalf of the citizens of Bosnia and Herzegovina sent an appeal to the European Court of Justice against the European Union, the Republic of Croatia and the High Representative for BiH Christian Schmidt, confirmed at the press conference the party president Semir Efendić and Zlatko Hadžidedić, author of the text of the appeal.

The reason is that the current high representative, "acting as an agent of the Republic of Croatia", as Hadžidedić said, is announcing a change in the constitutional order by amending the Election Law of Bosnia and Herzegovina, thereby siding with Croatia, which violates the Dayton Agreement even though it is one of the signatory countries. In this case, the High Representative puts Croatia in a superior position and Bosnia and Herzegovina in an inferior position, thus violating the principles of balance on which the peace treaty is based, Hadžidedić stated.

The reason for initiating a lawsuit against the European Union is that it is "responsible for the actions of Croatia as a member state, and the High Representative himself."

At this press conference, the Party for Bosnia and Herzegovina invited all citizens of Bosnia and Herzegovina to a large legal protest gathering and expression of rebellion by permitted means, because in the event of the collapse of the Dayton Agreement, the Constitution of the Republic of Bosnia and Herzegovina would automatically come into force and an extremely uncertain period for the country would follow, said Hadžidedić.

- It is high time to act - he declared, calling for a great civil resistance and added that the uncertainty would be especially complicated if one takes into account, as he says, the claims of Serbia and Croatia towards Bosnia and Herzegovina, internal threats of dissolution of the Republika Srpska entity and annexation to Serbia, as well as the ambitions of the Croatian Democratic Union regarding the reorganization of the creation of Herceg-Bosna.

The Party for Bosnia and Herzegovina decided to sue the European Court of Justice because domestic courts do not have jurisdiction over the actions of the High Representative, Croatia or the European Union, explained Hadžidedić. It has decided to act individually, as a party, and in the above-mentioned and only possible legal way, since state authorities do not take legal measures against violations of the Dayton Agreement, Hadžidedić's message.

In drafting the lawsuit, he was assisted by the advisory role of Francis Boyle, although the form of the appeal was drafted by himself, he said.
