Berton: A lot of fragmentation in terms of jurisdiction in BiH judiciary

SARAJEVO, December 18 (FENA) - Head of the OSCE Mission to Bosnia and Herzegovina, Ambassador Bruce G. Berton, believes that the judiciary sector in Bosnia and Herzegovina is pretty functional, but that there are many obstacles hindering it in terms of more efficient functioning.

Commenting on the questions from journalists about the situation in the BiH judiciary, Ambassador Berton assessed that there is a lot of fragmentation in terms of jurisdiction over court cases, stating that the overall state of affairs, among other things, is characterized by a lack of harmonization of laws at different levels.

He noted the existence of the state, entity and level of the Brčko District of BiH, alluding to the fragmentation of the judiciary in BiH, as well as the absence of harmonization of laws at these levels.

At the same time, he underlined the importance of strengthening judicial capacities through quality education of the holders of judicial functions in BiH, primarily dealing with criminal cases, including prosecution of war crimes, fight against corruption and organized crime, illegal trafficking in human beings and hate crimes.

Asked about to what extent the appointment of the Chief Prosecutor is important for improving the functioning of the judicial system, Berton pointed out that this is an extremely important process that must be freed of political influence.

“The person that is appointed as the chief prosecutor will have great responsibility in the fight against serious crimes, including, amongst other, war crimes and the fight against corruption,” said Ambassador Berton, responding to journalists’ questions during today's visit to the Center for education of judges and prosecutors in FBiH.
