SARAJEVO, April 19 (FENA) - Professor Lada Sadiković believes that Bosnia and Herzegovina should not have entered this emergency situation with the coronavirus pandemic in such a manner that had happened.
"Once again, its institutions have proven not to be effective enough to tackle this kind of threat in real-time," it was said today at an online conference of the Association of Independent Intellectuals "Circle 99".
Sadiković emphasizes the need for the Constitution of BiH or Annex 4 to be harmonized with the European Convention in order for Bosnia and Herzegovina to readily enter the state of emergency when such situations occur.
"With a hierarchical way of governing, one would know which state-level authorities give and to whom and when the powers to declare a state of emergency," she emphasized.
She adds that Bosnia and Herzegovina, as a state, in order to prepare for any possible situation (when regular legislation does not function), must contain provisions on the exercise of state power in a state of emergency, and who is the one precisely that declares a state of emergency.
"Constitutional theory says that, in most cases, it is incumbent Parliament which asks for the declaration of a state of emergency," she said.
Sadiković emphasizes that Bosnia and Herzegovina has an institution of Annex 10, which is made up of a high representative of the international community and has special powers for acting in a state of emergency.
