BiH Prosecution files an indictment in the ventilators procurement case

SARAJEVO, December 4 (FENA) - The Prosecutor's Office of Bosnia and Herzegovina has filed an indictment against Fadil Novalić, Fahrudin Solak, Fikret Hodžić, the legal entity "Srebrena malina“ from Srebrenica, as well as the FBiH Finance Minister and the Commander of the FBiH Civil Protection Staff, Jelka Milićević.

The accused - Fadil Novalić, Fahrudin Solak and Fikret Hodžić, as well as the legal entity "Srebrena malina" Srebrenica, are charged with having committed criminal offenses - association for the purpose of committing criminal offenses, and in connection with criminal offenses - abuse of position or authority, receiving a reward or other form of benefit for trading in influence, money laundering, forgery or destruction of business or trade books or documents, forgery of official documents, and a criminal offense - a violation of the obligation to keep records or business books and compiling financial statements, falsifying or destroying them.

At the same time, the accused Jelka Milićević is charged with having committed a criminal offense - negligent work in the service.

The Indictment charges the Accused with committing the aforementioned criminal offenses related to the procurement of 100 ventilators for treatment of Covid patients worth KM 10,530,000, and protective equipment worth KM 2,900,000 for the purpose of combating coronavirus in the Federation of Bosnia and Herzegovina in the period immediately after the declaration of the state of emergency. 

The accused Fadil Novalić is charged with using the circumstances of declaring a pandemic, as well as the capacities of the Prime Minister in the Government of the Federation of BiH, to devise a plan for illegal payment of budget funds for the purchase of funds and equipment for the fight against coronavirus together with Fahrudin Solak, Fikret Hodžić and the legal entity “Srebrena malina“ Srebrenica, the Prosecutor's Office of BiH stated.

"This joint group then procured one hundred ACM812A ventilators at inflated prices, in addition to the fact that the procured ventilators could not have been used for the purpose for which they were procured - for the treatment of Covid-19 epidemic, as a result of which property damage was caused to the budget of the Federation of BiH and for the illegal property gain to be divided between members of the associated group," it is stated in the statement.

The accused Jelka Milićević is charged with the criminal offense of negligent work in the service "because she knowingly violated the law and other regulations by enabling such procurement of ventilators, and then by failing to perform her duties prescribed by law, as she did not prevent harmful consequences".

The investigation against the suspect Aleksandar Zolak continues in a separate case because the investigation has been expanded in relation to the existence of grounds for suspicion that illegal decisions were made by the Agency for Medicines and Medical Devices in other cases as well.

At the same time, the Prosecutor's Office of BiH informs the public that the investigation against several other persons is continuing in relation to the criminal offense - assistance to the perpetrator after the criminal offense, and in relation to the procurement and distribution of the said ventilators, stated the BiH Prosecutor's Office.
