IDPI Mostar presents proposal for amendments to BiH Election Law

MOSTAR, December 14 (FENA) - The Institute for Socio-Political Research (IDPI) Mostar presented its proposals for amendments to the BiH Election Law, which, as stated at the panel discussion, can serve as a reservoir of operational mechanisms and institutional solutions to reach a compromise, the decisions of the BiH Constitutional Court and the European Court of Human Rights in Strasbourg were respected.

“The first half of 2021 or the beginning of its second half would be an optimal period in which political actors could reach a compromise. Our models are available to them. I do not expect anyone to rewrite our models from A to Z, but I think that they offer a reservoir of operational mechanisms, institutional solutions and even principles that can be an inspiration for specific measurements of the Election Law,” said in a press release a member of the IDPI expert team Milan Sitarski.

He pointed out that he hoped that next year, following the example of the agreement on the Mostar elections, an agreement would be reached on changes to the Election Law.

“I think this is the last chance because we are again at risk of holding the elections in 2022 with a hole in the Election Law,” said Sitarski.

The President of the Assembly and a member of the IDPI expert team, Ivan Vukoja, emphasized that the judgments of the Constitutional Court and the European Court of Human Rights are not excluded but supplemented, and that these judgments should be respected in BiH electoral legislation IDPI proposed the introduction of a "coefficient of electoral points".

“By using the mathematical model that we have called the coefficient of electoral points, we are not actually changing the boundaries of the existing constituencies at all and we are abolishing the obligation for candidates to declare themselves nationally. We ensured the legitimacy of the representation of the constituent peoples for those bodies intended by the Constitution for such representation by applying a mathematical formula which very simply consists in having in the county as a constituency a coefficient of electoral points obtained by determining the share of one people, say Croats in one county in relation to the total number of Croats in FBiH,” Vukoja explained.
