Švraka dismissed from the position of chief prosecutor of the Republic Prosecutor's Office of RS

SARAJEVO, October 25 (FENA) - The High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJPCBiH) considered and adopted the appeal of the Office of the Disciplinary Prosecutor of the HJPC BiH, and changed the decision of the Second Instance Disciplinary Commission for Prosecutors and imposed a disciplinary measure to Mahmut Švraka, the Chief Prosecutor of the Republic Prosecutor's Office of the Republika Srpska, transferring him from the position of the chief prosecutor to the position of the prosecutor of the Republic Prosecutor's Office of RS. 

In that procedure, the Second Instance Disciplinary Commission of the HJPC for Prosecutors, deciding on the defendant's appeal, changed the Decision of the First Instance Disciplinary Commission which imposed a disciplinary measure and reduced 30 percent salary on the defendant Švraka for six months.

The First Instance Disciplinary Commission of the HJPC of Bosnia and Herzegovina for prosecutors, deciding on the disciplinary complaint of the Office of the Disciplinary Prosecutor of the HJPC of Bosnia and Herzegovina, issued a Decision establishing the disciplinary responsibility of the defendant because he failed to act by the relevant provisions of the rulebook on the Prosecutor's Office Case Management System (TCMS) and the conclusion of the Council of 17 and 18 December 2014, by which the HJPC of Bosnia and Herzegovina "charges the chief prosecutors in BiH to ensure in their institutions that cases are assigned to all prosecutors through the TCMS".

It was also established that Švraka failed to take the necessary actions to eliminate possible technical obstacles to the allocation of cases through the automatic selection system, and he also failed to initiate the procedure of personal security checks of the employees of the Republic Prosecutor's Office of RS.

The decision of the HJPC of Bosnia and Herzegovina is final.

The HJPC elected Miodrag Bajić as the acting chief prosecutor of the Republic Prosecutor's Office of RS, who will perform this duty until the end of the competition procedure for the election of the chief prosecutor of the Republic Prosecutor's Office of RS, according to the announcement.
