OHR: Decision of BiH officials to resolve the issue of state property has been awaited for 28 years

SARAJEVO, May 12 (FENA) - The third meeting of experts on the issue of state property established by the Office of the High Representative of the International Community in Bosnia and Herzegovina (OHR) with the support of the Steering Committee of the Peace Implementation Council (PIC) should be held next week, the OHR confirmed for FENA.

The working group was formed with the task of collecting a set of expert opinions and information to help the BiH Parliamentary Assembly in addressing the issue of state property. It is expected that the recommendations could be forwarded to the BiH Parliamentary Assembly at the end of summer or early fall.

As OHR told FENA, it is planned that the Working Group, which is made up of distinguished domestic and international legal experts, will hold regular working sessions every two weeks, at which it will assess various technical and legal aspects of the ownership, use and management of state property, and analyze different asset management models, including examples from international practice.

An acceptable and sustainable solution to the issue of property distribution between the state and other levels of government is one of the five goals that the Peace Implementation Council established as part of the 5+2 Program but the decision of BiH institutions and BiH politicians, which would resolve the issue of state property, has been awaited for 28 years, OHR reminds.

When asked whether the OHR plans to help similarly in the solution of other issues related to the fulfillment of the objectives of the 5+2 Program, the OHR says that the results in terms of the implementation of that program should be achieved through domestic efforts and this also applies to the state and military property, but also for the rule of law, fiscal sustainability or the completion of the implementation of the Final Decision for Brčko.

The issue of state property was again brought up to date after the representatives of the authorities in the BiH entity Republika Srpska began to register state property to the entity, although this is strictly against the decisions of the Constitutional Court of Bosnia and Herzegovina, which has already clearly emphasized in several judgments that the issue of state property is within the competence of the state and it can be resolved only within the framework of the BiH Parliamentary Assembly.

In the description of state property, given by the Constitutional Court of Bosnia and Herzegovina, it is clearly stated that state property does not mean only a collection of real estate that serves the public authority, but state property is also a "public good" (seawater, seabed, river water, river beds, lakes, mountains, and other natural resources, public and transport network, transport infrastructure), which primarily serve all people in the country.
