EU Delegation in BiH: Continue harmonization on copyright with the EU standards

SARAJEVO, May 21 (FENA) - The delegation of the European Union and the Office of the EU Special Representative in Bosnia and Herzegovina considers it crucial that the competent authorities in BiH continue efforts to harmonize intellectual property rights and copyright and related rights with EU standards because their implementation is a significant part of future negotiations and accession to the European Union.

 

"Intellectual property rights and copyrights are of key importance for encouraging innovation and development. The EU has harmonized rules for the legal protection of intellectual property rights and copyright and related rights, which apply to all EU member states and with which countries that wish to become members must comply," the Communications Department of the EU Delegation in Bosnia and Herzegovina told FENA regarding the state of copyright in our country and the activities of the EU Delegation in this area.

They point out that, as stated in the latest Report on BiH (October 2022), the country is recording a moderate level of preparedness in the field of intellectual property rights, with the fact that there is no progress in further harmonization with EU standards and that the legal framework on copyright and related rights is largely aligned with the EU acquis.

The EU delegation in BiH believes that it is necessary to revise the provisions for works without authors and the right of collective management to harmonize them with the EU acquis in this area and that the competent authorities in BiH should do more in harmonizing legislation, as well as ensuring implementation and coordination.

Since 2008, the European Union has supported the protection of intellectual property in Bosnia and Herzegovina through a series of projects, achieving significant results in harmonizing legislation and implementation of intellectual property.

"Through the current project worth over 1.8 million euros, the EU provides the necessary expertise and support to the Institute for Intellectual Property of Bosnia and Herzegovina, as well as to creative companies and individuals in Bosnia and Herzegovina to achieve similar protection of intellectual property rights as in the EU," the EU Delegation in Bosnia and Herzegovina stated.

This project is aimed at building the capacity of institutions in BiH responsible for the protection and enforcement of intellectual property rights through the improvement of their cooperation, amendments and additions to the legislation related to intellectual property and its further harmonization with the EU acquis.

The project also refers to raising general public awareness about intellectual property rights.
