Čolović: Respect for consumer rights in BiH unsatisfactory

SARAJEVO, March 14 (FENA) - Assistant Ombudsman for Consumer Protection in BiH Ljubica Čolović said that respect for the rights of consumers in BiH, and in the world, is unsatisfactory and that these rights are violated in numerous segments.

“This is supported by numerous consumer complaints made to the Ombudsman Institution. The number of complaints is approximately the same or slightly increased in relation to 2016, which is, in any case, a significant indicator of consumer rights violations by producers, service providers, traders and other participants. However, the number of complaints in 2016 must be taken conditionally, as the practice of filing complaints and their registration, which includes a larger group of citizens, has continued,” Ms. Čolović told FENA.

In addition, Ms. Čolović explained, the recorded cases are often complex and include multiple rights violations, which additionally confirms the degree of vulnerability of consumers' rights.

On the occasion of March 15, the World Consumer Rights Day, Ms. Čolović told FENA that the majority of complaints relate to sectors of economic services of general interest, trade, and financial services.

“We can rightly conclude that almost all economic services of general interest (utility services - electricity, water, heating, telecommunication services, public transport) take place in a monopoly environment and a non-contractual framework with a lump-sum method of calculating the price, thus making the damage to the economic interest of consumers almost immeasurable. Inability to terminate certain contracts, e.g. on the provision of heating services, is, unfortunately, a blatant example of non-compliance with the basic principles of contractual and consumer law. Given that the group of citizens who use these general services is the largest and given that they are among the essential services, the services of vital importance, we think that these forms of consumer rights violations in BiH are the most alarming,” Ms. Čolović stressed.
